TERMS & CONDITIONS – REPLACEMENT OF INSULATED GLASS UNITS (IGUs)
General
These Terms & Conditions govern the replacement of Insulated Glass Units (IGUs) supplied by KONIFER.
All IGU replacements are subject strictly to these conditions. Any deviation must be approved in writing by KONIFER.

Warranty Validation Requirement
IGU replacement shall ONLY be considered if:
• A valid KONIFER invoice is provided
• Full payment of the original invoice has been received
• The claim is submitted within the warranty period (1 year from invoice date)
• The defect is verified by KONIFER as a manufacturing seal failure only
KONIFER reserves sole discretion to approve or reject all claims.

Scope of Replacement
Approved replacements are strictly limited to:
• Supply of replacement IGU units only (FOB basis)
KONIFER is NOT responsible for:
• Removal of existing units
• Installation of replacement units
• Site access, scaffolding, swing stages, or equipment
• Any associated labour or coordination

Installation Disclaimer
KONIFER does NOT warrant or assume responsibility for:
• Installation practices by others
• Glazing methods or systems
• Sealant application or compatibility
• Frame conditions, tolerances, or alignment
All IGU performance is dependent on proper installation by others, which remains outside KONIFER’s scope.

Site Conditions & Access
Replacement is subject to:
• Safe and unrestricted access to affected areas
• Proper site readiness prior to replacement
• Coordination by others (GC / owner / installer)
If site conditions are deemed unsafe, incomplete, or unsuitable, KONIFER reserves the right to:
• Delay replacement
• Refuse service until conditions are corrected

Exclusions from Replacement
A. Non-Manufacturing Causes
• Improper installation or glazing
• Structural movement or building settlement
• Frame distortion or deflection
• Poor drainage or ventilation
B. Physical Damage
• Glass breakage
• Scratches, chips, or abrasions
• Impact or misuse
C. Environmental Factors
• Excessive humidity or condensation (non-seal related)
• Chemical exposure or aggressive cleaning
• Coastal or corrosive environments
D. Design & Specification Issues
• Incorrect glass specification
• Thermal stress due to design
• Altitude or pressure differences not accounted for
• Improper installation or glazing
• Structural movement or building settlement
• Frame distortion or deflection
• Poor drainage or ventilation

Replacement Timeline
All approved IGU replacements shall be:
• Subject to production lead times
• Scheduled based on manufacturing availability
• Delivered without any guarantee of expedited timelines
KONIFER shall not be liable for project delays arising from replacement timelines.

Costs & Charges
Unless explicitly agreed in writing:
• Replacement units are provided at KONIFER’s discretion
• All labour, access, logistics, and reinstallation costs are the sole responsibility of others
If a claim is determined to be invalid:
• All costs incurred (inspection, handling, transport) shall be charged to the claimant
• Replacement units are provided at KONIFER’s discretion

Limitation of Liability
KONIFER’s liability is strictly limited to:
• The original supply value of the IGU only

• Indirect, incidental, or consequential damages

Inspection Rights
KONIFER reserves the right to:
• Inspect the IGU in installed condition
• Request removal for further evaluation

Non-Transferability
These terms apply only to the original purchaser listed on the KONIFER invoice and are not transferable.
Final Condition
By requesting or accepting IGU replacement, the customer acknowledges and agrees that:
• KONIFER’s responsibility is limited strictly to manufacturing defects
• All installation, design, and site-related risks remain the responsibility of others
