(Applicable to KONIFER-Supplied Systems Only)
General
These Terms & Conditions govern all retrofit, upgrade, replacement, and modification works involving:
• PVC Window Systems
• Aluminum Window Systems
• Glazing & IGU replacements
• Associated façade or opening upgrades
ONLY for products originally supplied by KONIFER.
No work shall proceed unless these Terms & Conditions are accepted in full.

Eligibility
Retrofit and upgrade services shall ONLY apply where:
• Original products were supplied by KONIFER
• Valid KONIFER invoice or project reference is provided
• System identification can be verified by KONIFER
KONIFER reserves the right to refuse retrofit work if system origin or condition cannot be confirmed.

Existing Conditions Disclaimer (Critical)
All retrofit work is performed on existing structures and previously installed systems, which may include:
• Unknown site conditions
• Hidden deficiencies
• Structural movement or settlement
• Improper original installation
KONIFER makes NO representation or warranty regarding:
• Existing building conditions
• Structural integrity
• Compatibility with new or upgraded components
All retrofit work is performed at the sole risk of the customer.

KONIFER’s scope is strictly limited to:
• Supply of replacement or upgraded components
• Optional installation only if explicitly agreed in writing

• No responsibility for adjacent systems or trades

Design & Performance Limitations
Retrofit upgrades are constrained by:
• Existing openings and framing conditions
• Original building design
• Site tolerances and limitations
KONIFER does NOT guarantee that retrofit systems will:
• Achieve new-build performance levels
• Meet updated code requirements unless explicitly specified
• Eliminate all air, water, or thermal issues
Performance is conditional and limited by existing conditions.

Installation Responsibility
Unless installation is contracted directly with KONIFER:
• All installation is the responsibility of others
• KONIFER assumes no liability for installation quality

• Work is limited strictly to defined scope
• No responsibility is accepted for pre-existing deficiencies

Site Conditions & Access
All work is subject to:
• Safe and unobstructed site access
• Proper preparation by others
• Completion of prerequisite work by other trades
KONIFER reserves the right to:
• Suspend work due to unsafe or unsuitable conditions
• Issue change orders for delays, rework, or access issues

Change Orders (Important)
Retrofit work is inherently unpredictable.
Any of the following shall result in additional charges:
• Hidden conditions discovered during work
• Structural or substrate deficiencies
• Additional labour or materials required
• Rework caused by other trades
All changes shall be documented and charged accordingly.

Exclusions
KONIFER shall NOT be responsible for:
• Water infiltration due to existing building defects
• Structural movement or building settlement
• Interface failures between old and new systems
• Damage caused by removal of existing systems
• Interior or exterior finishing repairs (drywall, paint, cladding, etc.)
• Compatibility with third-party products or systems

Warranty Limitation
Retrofit and upgrade works are provided with:
NO EXTENDED PERFORMANCE WARRANTY
Any supplied components shall be covered only under:
• Standard KONIFER product warranty (if applicable)
KONIFER provides NO warranty for:
• Integration with existing systems
• Overall building envelope performance
• Pre-existing or latent defects

Liability Limitation
KONIFER’s liability is strictly limited to:
• The value of materials supplied for the retrofit scope
KONIFER shall NOT be liable for:
• Labour costs
• Access equipment
• Damage to surrounding materials
• Project delays
• Indirect or consequential damages

Payment Terms
• All retrofit work is subject to advance payment or agreed milestone terms
• Any delays in payment may result in work suspension
• Additional costs arising during work must be paid prior to continuation

Claims & Deficiencies
All claims must:
• Be submitted in writing within 7 days of completion
• Clearly identify the issue
• Allow KONIFER access for inspection

Non-Transferability
These Terms & Conditions apply only to the original customer and are not transferable.
Final Acknowledgement
By proceeding with retrofit or upgrade work, the customer acknowledges that:
• Retrofit work involves inherent risks due to existing conditions
• Performance is limited by the original building and installation
• KONIFER’s responsibility is limited strictly to defined scope and supplied components
